Introduction

Welcome to Labshock Security LLC ("Labshock", "we", "our" or "us"). By accessing or using our services, including our website and training modules, you agree to comply with these Terms of Service and our Privacy Policy. If you do not agree, please refrain from using our services.

Services Provided

Labshock provides an OT/ICS cybersecurity simulation and training platform designed for: - Security professionals - Engineers - Researchers - Organizations conducting demonstrations, testing, and training in controlled environments Our platform enables users to simulate industrial environments for defensive security validation, training, and proof-of-concept purposes.

Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to use our services.

Accounts and Security

- You are responsible for maintaining the confidentiality of your account credentials - You are responsible for all activity under your account - You must notify us immediately of any unauthorized access or suspected breach

License Grant

Subject to these Terms and payment of applicable fees, Labshock grants you a: - Limited - Non-exclusive - Non-transferable - Non-sublicensable license to access and use the Labshock platform in accordance with the plan you have purchased (Pro or Enterprise). This license is granted solely to the purchasing entity or individual and may not be transferred to another party without our written consent.

Pro License Terms

For Pro plans: - License is granted to a single user - Use is limited to personal / individual purposes - No commercial usage is allowed - No company usage is allowed - Sharing access credentials with others is prohibited - Use is limited to the scope defined in the purchased plan

Enterprise License Terms

For Enterprise plans: - License is granted to a single legal entity - Multi-user access is permitted within the number of purchased seats - Users must be employees or authorized contractors of the licensee - Deployment may be on-premise as permitted by the agreement - Commercial use is permitted Commercial use is including: - Internal training - Proof-of-concept engagements - Product demonstrations - Client-facing evaluations Restrictions: - Enterprise licenses do not include the right to resell, sublicense, or redistribute Labshock - Multi-entity usage or reseller usage requires a separate written Partner or Reseller Agreement

Training, Courses, and Educational Use

- Labshock may be used within structured training programs, bootcamps, academic courses, and corporate education environments under an Enterprise license. - Enterprise customers may provide access to Labshock to enrolled participants, employees, or authorized learners within the scope of their license. - Use of Labshock as part of instructional delivery (including live labs, workshops, and hands-on training sessions) is permitted under Enterprise licensing. - Recording or distribution of training materials derived from Labshock is permitted only when no sensitive, customer-specific, or identifiable environments are included, unless otherwise agreed in writing.

License Restrictions

You agree not to: - Resell, sublicense, or redistribute Labshock or any part of it - Share access outside your licensed organization - Reverse engineer, decompile, or attempt to extract source code (unless legally permitted) - Use the platform to build a competing product - Use the service in violation of applicable laws or regulations - Circumvent access controls or licensing mechanisms - Distribute, publish, or commercialize recordings or derived content from Labshock environments in a way that exposes sensitive, customer-specific, or identifiable configurations without authorization

Payment and Billing

- Fees for services are clearly displayed prior to purchase - Payment is processed via authorized third-party payment providers - By placing an order, you agree to pay all applicable fees - For enterprise customers, payment may be governed by a Purchase Order (PO) and invoice process

Purchase Orders and Contract Formation

Where applicable: - A Purchase Order constitutes an offer to purchase our services - Acceptance occurs upon confirmation or issuance of an invoice by Labshock - All purchases are subject to these Terms of Service - Reference to these Terms may be included in invoices, quotations, or purchase confirmations

Refund Policy

Refund requests must be submitted within 30 days of purchase. Refund eligibility is evaluated on a case-by-case basis at Labshock’s discretion.

Intellectual Property

All content, including but not limited to: - Software - Documentation - Training materials - Platform design and features are the intellectual property of Labshock Security LLC and are protected by applicable copyright and trademark laws. No rights are granted except as explicitly stated in these Terms.

Acceptable Use

You agree to use the platform only for lawful purposes, including: - Cybersecurity training - Testing and simulation in controlled environments - Authorized professional use Prohibited activities include: - Unauthorized access to systems - Misuse of the platform for malicious purposes - Distribution of harmful or illegal content through the platform

Privacy and Data Processing

Your use of our services is also governed by our Privacy Policy: https://labshocksecurity.com/privacy We do not process personal data beyond what is necessary for: - Account management - Platform operation - Security and logging

Availability and Modifications

We may: - Modify, update, or discontinue parts of the service - Improve features or performance at any time - We do not guarantee uninterrupted availability.

Termination

We reserve the right to suspend or terminate access if: - You violate these Terms - You misuse the platform - Payment obligations are not met Upon termination: - Your license to use the platform will cease - You must stop using the service immediately

Disclaimer of Warranties

The services are provided on an “as is” and “as available” basis. We make no warranties, express or implied, including but not limited to: - Fitness for a particular purpose - Uninterrupted availability - Error-free operation

Limitation of Liability

To the maximum extent permitted by law Labshock Security LLC shall not be liable for: - Indirect, incidental, or consequential damages - Loss of data, profits, or business opportunities - Damages arising from use or inability to use the service

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Carolina, United States. Any disputes shall be subject to the exclusive jurisdiction of the courts located in South Carolina, United States.

Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page Continued use of the service constitutes acceptance of the updated Terms
